In plain terms. eMotion Picture is desktop software you run on your own computer, on your own media. You keep ownership of your files. We provide the software as-is and cannot be responsible for your data — keep your own backups.

1. Acceptance of terms

By downloading, installing or using eMotion Picture ("the Software"), you agree to these Terms of Service. If you do not agree, do not install or use the Software.

2. Description of the service

eMotion Picture is a desktop application for organising personal photo and video libraries. It indexes media you point it at, detects and groups faces, extracts metadata, and can assemble videos and mosaics. Processing runs locally on your computer. Optional integrations let you import from, or upload to, third-party services such as Google Drive, Google Photos and YouTube.

3. Eligibility

You must be at least 13 years old, and old enough to form a binding contract in your jurisdiction, to use the Software.

4. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Software. You may not resell, sublicense or redistribute it, and you may not remove or obscure any proprietary notices.

5. Your content

You retain all rights to your photos, videos and any output you create with the Software. We claim no ownership of your content and, because the Software runs locally, we do not receive it.

7. Third-party services

Optional integrations depend on services operated by others. Your use of those services is governed by their own terms and privacy policies. We are not responsible for their availability, changes to their APIs, or any action they take on your account. Access can be revoked by you, or by them, at any time.

8. Updates

The Software may check for and install updates. Updates are cryptographically signed and verified before being applied. We may change, suspend or discontinue features in future versions.

9. Disclaimer of warranties

The Software is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or that face detection, grouping or metadata extraction will be accurate.

10. Limitation of liability

To the maximum extent permitted by law, DAaM.ai will not be liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of data, media, profits or goodwill, arising from your use of or inability to use the Software — even if advised of the possibility. Keep independent backups of anything you cannot afford to lose.

11. Indemnification

You agree to indemnify and hold harmless DAaM.ai from any claim arising out of your use of the Software, your content, or your violation of these terms or of any law or third-party right.

12. Termination

You may stop using the Software at any time by uninstalling it. We may terminate this licence if you materially breach these terms. Sections 5, 9, 10 and 11 survive termination.

13. Changes to these terms

We may revise these terms. The "last updated" date above reflects the current version, and continued use after a change constitutes acceptance.
